Terms of Use and Conditions of Sale — Charmese

IMPORTANT: Please read these Terms before accessing or using our website. By making a purchase or using our services, you agree to be bound by these Terms. Nothing in these Terms limits or excludes the statutory rights you have as a consumer under the law of your country.

1. Acceptance of Terms

Your use of charmese.com and of all services, products and content provided by Charmese is subject to these Terms. Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you. By accessing the site or making a purchase, you confirm that:

  • You are of legal age in your country, state or province of residence.

  • You have the legal capacity to enter into binding contracts.

  • You have read, understood and accepted these Terms in full.

We reserve the right to update these Terms at any time. Your continued use of the site after changes are posted constitutes acceptance of those changes. The current version is always available at charmese.com/policies/terms-of-service.

2. Privacy and Data Protection

Our Privacy Policy, available at charmese.com/policies/privacy-policy, forms part of these Terms and describes how we collect, use and protect your personal information in accordance with the CCPA/CPRA (California) and other U.S. state privacy laws, the GDPR (EU/UK), PIPEDA (Canada), the Privacy Act (Australia), the LGPD (Brazil), the APPI (Japan), the PDPA (Singapore) and other applicable laws.

3. Business Model — Direct Shipping (Dropshipping)

Charmese works with a direct-ship (dropshipping) model. This means products are shipped directly by our fulfillment partners, who may be located in different countries. As a result:

  • Delivery times may be longer than those of traditional local stores (typically 15 to 45 business days for some international destinations).

  • Orders with multiple items may arrive in separate shipments from different suppliers.

  • Products may originate from a country other than the one in which the store operates.

  • Any import duties or customs fees are the customer's responsibility, according to the law of the destination country.

4. User Conduct

When using the site, you agree not to:

  • Use it for any unlawful or unauthorized purpose in any jurisdiction.

  • Carry out cyberattacks or any action that compromises the security of the site.

  • Post content that is abusive, defamatory, discriminatory or that infringes the rights of others.

  • Infringe the intellectual property rights of Charmese or any third party.

  • Upload viruses, malware or any other malicious code.

  • Collect personal data of other users without consent.

  • Attempt unauthorized access to systems, accounts or networks related to the site.

  • Perform web scraping or automated data extraction without written authorization.

Charmese reserves the right to suspend or terminate your access to the site if you breach these Terms, without prior notice and without liability of any kind.

5. Products for Personal Use

Products purchased at charmese.com are intended solely for personal, non-commercial use. Unauthorized resale, redistribution, modification or export is prohibited. We reserve the right to cancel orders that, in our judgment, indicate unauthorized resale or distribution activity.

6. Product Information — Health Disclaimer

The content on the site is for general informational purposes only and does not constitute medical advice, diagnosis or treatment. These statements have not been evaluated by the Food and Drug Administration (FDA) or by equivalent authorities such as Health Canada, the EMA (European Union), the TGA (Australia) or ANVISA (Brazil). Our products are not intended to diagnose, treat, cure or prevent any disease.

Consult a qualified healthcare professional before using any product, especially if you have a pre-existing condition, are pregnant or breastfeeding, or take medication. Individual results may vary and are not guaranteed.

Product images are for illustration purposes. We reserve the right to correct typographical errors, inaccuracies or omissions at any time without prior notice.

7. Prices, Currencies and Taxes

Prices on the site may be displayed in different currencies depending on your location. The final amount charged will depend on the selected currency and the exchange rate applied by the payment provider at the time of purchase.

Unless stated otherwise at checkout, prices do not include import duties, customs fees, VAT, GST or any other local taxes. These charges are the sole responsibility of the customer and vary by destination country and applicable tax law. Applicable U.S. sales tax is calculated and shown at checkout.

All prices are subject to change without notice. In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.

8. Payment

By providing payment information, you represent that:

  • You are authorized to use the payment method provided.

  • The information is complete, current and accurate.

  • Sufficient funds or credit are available to cover the order amount.

Payments are processed by certified, secure payment providers. Charmese does not store credit or debit card data. We are not responsible for additional fees charged by your bank or card issuer. In the event of an unjustified chargeback, we reserve the right to recover the amount through other means and suspend your account.

9. Orders, Subscriptions and Cancellations

Order acceptance. An electronic confirmation does not constitute final acceptance of your order. We may decline orders due to lack of stock, suspected fraud, pricing errors, shipping restrictions to the destination country or any other reason. If an order is declined, we will issue a full refund.

Subscriptions. Subscriptions renew automatically at the frequency you select. You can modify or cancel through the customer portal at charmese.com or by emailing support@charmese.com. Please cancel at least 24 hours before your next renewal to avoid being charged.

Order cancellation. Orders can only be canceled before they are shipped by our fulfillment partner. Once shipped, please request a refund under our Refund Policy. Contact us right away at support@charmese.com.

10. Shipping and Delivery

We ship worldwide through logistics partners that may be located in different countries. Delivery times are estimates and may vary. Please see our Shipping Policy at charmese.com/policies/shipping-policy.

Charmese is not responsible for delays caused by customs, carriers, weather events, strikes, pandemics or incorrect shipping information provided by the customer. Import duties and taxes are the sole responsibility of the customer.

11. Satisfaction Guarantee and Refunds

Charmese offers a 30-day satisfaction guarantee under the Refund Policy available at charmese.com/policies/refund-policy. This guarantee is in addition to, and does not replace, the statutory consumer rights provided by the law of your country, including:

  • The 14-day right of withdrawal (European Union and United Kingdom).

  • Rights to repair, replacement or refund for faulty products (Australia — ACL).

  • The 7-day right of withdrawal (Brazil — Consumer Defense Code).

  • Any other rights under your local consumer protection laws.

12. Intellectual Property

All content on the site — text, images, logos, videos, designs, interfaces and data compilations — is owned by or licensed to Charmese and is protected by copyright, trademark and intellectual property laws applicable internationally.

You may access and view the content for personal, non-commercial use only. Any reproduction, distribution, modification or creation of derivative works without the prior written consent of Charmese is strictly prohibited and may result in civil and criminal liability.

13. Reviews, Testimonials and User Content

By submitting reviews, photos, testimonials or other content, you grant Charmese a non-exclusive, worldwide, royalty-free and irrevocable license to use that content for commercial and marketing purposes. You represent that the content is truthful, accurate and does not infringe the rights of any third party. Testimonials do not represent the typical experience of all users.

14. Social Media

Our social media presence is subject to the terms of each platform. User comments and opinions do not reflect the views of Charmese. We reserve the right to moderate inappropriate content.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the site and products are provided "as is" and "as available", without warranties of any kind, whether express or implied. Nothing in this section affects the statutory consumer rights provided by the Australian Consumer Law, the UK Consumer Rights Act, the Brazilian Consumer Defense Code or equivalent laws.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Charmese shall not be liable for any indirect, special, incidental, consequential or punitive damages. If Charmese is found liable, its maximum liability shall not exceed the total amount you paid for the order giving rise to the claim. These limitations do not apply where prohibited by local law or in cases of willful misconduct or gross negligence, and they do not affect your statutory consumer rights.

17. Dispute Resolution

In the event of a dispute, the parties will first attempt to resolve it amicably by contacting support@charmese.com. If this is not possible, the dispute will be submitted to the competent courts of the State of New Mexico, United States, unless the consumer protection law of the customer's country requires a different venue — in which case the local law prevails.

  • 🇪🇺 European Union: the consumer protection authority or European Consumer Centre (ECC-Net) in your country.

  • 🇦🇺 Australia: Australian Competition and Consumer Commission (ACCC) at accc.gov.au.

  • 🇨🇦 Canada: Office of Consumer Affairs at ised-isde.canada.ca.

  • 🇧🇷 Brazil: state PROCON and consumidor.gov.br.

  • 🌏 Other countries: your competent local consumer protection agency.

18. Indemnification

You agree to indemnify and hold harmless Charmese and its representatives from any claim, damage or cost (including reasonable attorneys' fees) arising from your breach of these Terms, any false statements, or your violation of any law or third-party right.

19. Third-Party Links

The site may contain links to third-party websites. Charmese is not responsible for the content or practices of those sites. Please review their terms before interacting with them.

20. Electronic Communications

You agree that electronic communications sent by Charmese have the same legal validity as paper communications, in accordance with the applicable law in each country, including the U.S. E-SIGN Act.

21. General Provisions

Severability. If any provision is held invalid, the remaining provisions remain in full force and effect.

No waiver. Failure to exercise any right does not constitute a waiver of that right.

Entire agreement. These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy and Legal Notice, constitute the entire agreement between you and Charmese.

Language. These Terms are written in English. In the event of a conflict between language versions, the version in the consumer's local language will prevail where required by law.
